Terms of Service

These are the Terms of Service ("Terms") between you and Pygsite ("we," "us," or "our"). They cover your use of our construction management platform, website, and related services (together, the "Services"). By using our Services, you agree to these Terms and to follow all applicable laws. If you don't agree, please don't use the Services.
1. Accepting These Terms
By creating an account or using Pygsite, you agree to these Terms and our Privacy Policy. These Terms apply to everyone who uses the Services — whether you're an owner, project manager, contractor, or team member.
If you're using Pygsite on behalf of a company or organisation, you confirm that you have the authority to agree to these Terms on their behalf.
2. What Pygsite Does
Pygsite is a cloud-based construction management platform. You can use it to:
- Create and manage construction projects
- Track tasks, schedules, and progress
- Work with your team and subcontractors
- Upload and manage photos, documents, and files
- Generate reports and daily logs
- Communicate with clients, team members, and collaborators
We may change, pause, or discontinue parts of the Services from time to time. Where possible, we'll give you notice before making significant changes.
3. Your Account
To use certain features, you'll need to create an account. When you do, you agree to:
- Provide accurate and up-to-date information
- Keep your login details secure
- Take responsibility for activity on your account
- Tell us straight away if someone accesses your account without permission
Don't share your account or use someone else's. We may suspend or close accounts that breach these Terms, are involved in fraudulent activity, or are harmful to the Services or other users.
4. Acceptable Use
Don't use Pygsite to:
- Break any laws or violate anyone's rights
- Upload viruses, malware, or harmful code
- Interfere with or disrupt the Services
- Try to access systems or data you shouldn't
- Impersonate someone else
- Harass, threaten, or abuse other users
- Upload illegal or offensive content
- Scrape, crawl, or reverse-engineer the Services
- Remove or alter any proprietary notices
If you break these rules, we may remove content, suspend your account, or report the activity to the relevant authorities.
5. Intellectual Property
What's Ours
Pygsite and its content, features, and design are owned by us and protected by copyright, trademark, and other intellectual property laws. You can't copy, modify, distribute, sell, or lease any part of the Services without our written permission.
What's Yours
You keep ownership of everything you upload — project data, photos, documents, and communications ("Your Content").
By uploading content, you give us a licence to use it for the purposes of running, improving, and promoting the Services. This licence is non-exclusive, worldwide, and royalty-free. We need this licence so we can store, display, and process your content as part of the platform — we won't sell your content or use it in ways unrelated to the Services.
You confirm that you have the rights to upload your content, that it doesn't infringe anyone else's rights, and that it complies with all applicable laws.
6. Payment and Billing
Some features require a paid plan. If you subscribe, you agree to:
- Pay the fees for your chosen plan
- Provide accurate billing information
- Authorise us to charge your payment method
- Pay any applicable taxes
Subscriptions are billed in advance (monthly or annually) and renew automatically at the current rate unless you cancel before the renewal date. Fees are generally non-refundable, except where required by law.
We may change our pricing from time to time. Price changes will apply from your next billing period. All fees are exclusive of taxes — you're responsible for any that apply.
If payment fails, we may suspend your account until the balance is settled.
7. Disclaimers and Liability
No Guarantees
We provide the Services "as is" and "as available." To the extent the law allows, we don't make guarantees about the Services — including that they'll be uninterrupted, error-free, or free of harmful components.
We work hard to keep things running well, but we can't promise perfection. Any content you download or use through the Services is at your own risk.
Limits on Our Liability
To the extent the law allows, Pygsite and its team won't be liable for indirect, incidental, special, or consequential damages — including lost profits, lost data, business interruption, or the cost of replacement services — arising from your use of the Services, regardless of how the claim arises (contract, negligence, or otherwise), even if we've been told such damages are possible.
Our total liability for any claims related to these Terms or the Services is limited to the greater of (a) what you paid us in the 12 months before the issue arose, or (b) $100 USD.
None of this limits liability that can't be excluded under applicable law, including under Irish or EU consumer protection rules. Where the law sets a higher floor, that floor applies.
Your Responsibility
If your use of Pygsite causes a problem — for example, if you upload content that infringes someone's rights, or if you breach these Terms — you agree to cover our reasonable costs and losses (including legal fees) that result from it. This applies to claims from third parties related to your use of the Services, your content, or any violation of these Terms or applicable law.
8. Data Protection and Privacy
We protect your data in line with the GDPR, the Irish Data Protection Act 2018, and other applicable data protection laws. How we collect, use, and share your information is set out in our Privacy Policy.
You're responsible for making sure your own use of the Services complies with data protection laws — including getting any necessary consent from your team members or project participants.
When you use the Services to handle personal data of others (like your employees or subcontractors), you're the data controller and Pygsite acts as the data processor. You need to have a lawful basis for that processing.
Data Retention and Export
Your project data, daily logs, photos, documents, and files stay put for as long as your account is active. We won't delete or archive your data while your account is in good standing.
You can export your data at any time using the export features in the platform. We're committed to keeping your data accessible and exportable for the life of your account.
If you cancel or downgrade, your existing data is preserved — you don't lose access to projects, logs, or files you've already created. Feature access may change based on your plan, but your data stays yours.
9. Cancellation and Termination
You can cancel your account at any time through our cancellation process or by contacting us. We can suspend or close your account if you breach these Terms, engage in fraudulent or illegal activity, or for other legitimate reasons (like a security issue or prolonged inactivity).
If your account is closed, you lose access to the Services and remain responsible for any fees already owed.
After you cancel, we'll keep your data for 90 days so you have time to export anything you need. After that, we may permanently delete it. We'll make reasonable efforts to let you know before deletion.
If we close your account for a Terms violation, we may delete your data sooner — but we'll try to give you a chance to export where practical. Some sections of these Terms (like ownership, liability limits, and dispute resolution) continue to apply after termination.
10. Changes to These Terms
We may update these Terms from time to time. When we do, we'll update the "Last updated" date at the top of this page and post the new version here.
For significant changes, we'll try to give you notice — by email or through the platform. If you keep using the Services after the changes take effect, that counts as acceptance. If you don't agree with the updated Terms, stop using the Services and close your account.
11. Governing Law and Disputes
These Terms are governed by the laws of Ireland. Any legal disputes will be handled by the Irish courts.
If you're a consumer in the EU, you also have the benefit of any mandatory consumer protection laws in your home country. Nothing in these Terms takes those rights away.
EU consumers can also use the European Commission's online dispute resolution platform at https://ec.europa.eu/consumers/odr.
12. General
Whole agreement: These Terms and our Privacy Policy are the full agreement between you and Pygsite for the Services.
Severability: If any part of these Terms is found to be unenforceable, the rest still applies.
Waiver:If we don't enforce a particular right under these Terms, that doesn't mean we've waived it.
Assignment:You can't transfer these Terms to someone else without our written consent. We can transfer them without restriction.
Force majeure:We're not liable for delays or failures caused by things beyond our reasonable control.
